The new law extends the time period in which medical and dental records must be maintained from 5 to 7 years during which time a health care provider is prohibited from destroying medical records, laboratory studies, and x-ray reports (the time period for a minor is also extended as well). The law also adds a new requirement for notice by email to a patient or parent/guardian of a minor patient regarding the destruction of medical records. Finally, the law also requires health care providers to make the medical record available for retrieval by a patient or parent/guardian of a minor within 60 days before the date of destruction at the location designated in the notice.
